Terms of Service

The agreement

These Terms are an agreement between you and FightNome ("we", "us") — not between you and Apple. We alone are responsible for FightNome and its content.

By downloading or using the app you accept these Terms. If you do not accept them, do not use FightNome.

Your license

We grant you a personal, non-transferable license to use FightNome on any Apple device you own or control, as permitted by the App Store Terms of Service. You may not sell, rent, sublicense or redistribute the app, reverse-engineer it, or extract its audio, artwork or written content for use elsewhere.

Subscriptions, trials and cancellation

FightNome is sold as an auto-renewing subscription, monthly or yearly. The current price, the billing period and any free trial are shown on the purchase screen before you buy, and are charged to your Apple Account.

A subscription renews automatically at the end of each period unless you turn off auto-renew at least 24 hours before it ends. Your account is charged for renewal within 24 hours before the period ends.

Where a free trial is offered, it applies to the yearly plan only. If you do not cancel before the trial ends, it converts to a paid subscription at the price shown. Any unused part of a trial is forfeited when you buy a subscription.

Manage or cancel your subscription in your Apple Account settings — we cannot cancel it for you. Refunds are handled by Apple under the App Store Terms of Service.

Train safely

FightNome gives general fitness and technique guidance. It is not medical advice, and it is not a substitute for a coach who can see you.

Consult a physician before starting any exercise program, particularly if you have an injury or a heart condition, are pregnant, or have been inactive. Stop immediately if you feel pain, dizziness or shortness of breath.

Combat sports carry a risk of injury. You train at your own risk, you are responsible for your surroundings and your equipment, and you should work within your own ability rather than the pace the app calls.

Your content and your data

The workouts you build, the sessions you train and the profile you set up are yours. They are stored on your device and, if you use iCloud, in your own private iCloud database that we cannot read. Our Privacy Policy describes this in full.

Maintenance and support

We are solely responsible for providing any maintenance and support for FightNome. Apple has no obligation to furnish any maintenance or support services.

Warranty

FightNome is provided "as is", to the fullest extent permitted by law, without warranties of any kind. We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed.

If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to FightNome.

Nothing here limits rights you have under mandatory consumer law where you live.

Claims and liability

We, not Apple, are responsible for addressing any claim relating to FightNome, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.

To the extent permitted by law, we are not liable for indirect or consequential loss, or for injury arising from training. Our total liability is limited to what you paid for FightNome in the twelve months before the claim.

Intellectual property

FightNome — including its coach audio, the FightNome Mix backing music, its artwork and its written content — belongs to us or our licensors.

In the event of any third-party claim that FightNome or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.

Legal compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-party terms

You must comply with any applicable third-party terms of agreement when using FightNome — your wireless data plan's terms, for example.

Apple's role

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of them Apple will have the right — and will be deemed to have accepted the right — to enforce these Terms against you as a third-party beneficiary.

Changes and ending

We may update these Terms as FightNome changes. Material changes will be shown in the app, and continuing to use FightNome after one means you accept the updated Terms.

You may stop using FightNome at any time by canceling your subscription and deleting the app.

Governing law and contact

These Terms are governed by the law of Poland, without affecting mandatory consumer protections where you live.
